These terms and conditions (the “Terms”) govern the purchase and use of gift cards (“Gift Cards”) issued by Be Well Clinic (“Company,” “we,” “us,” or “our”). By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms.
1. Acceptance and Use
1.1. Acceptance: Gift Cards are redeemable only for merchandise and services sold by the Company at Be Well Clinic, 2 Aberford Road, Garforth LS15 8BD.
1.2. Non-Redemption: Gift Cards cannot be redeemed for cash, except where required by law.
1.3. No Resale: Gift Cards are not for resale. Any Gift Card obtained from an unauthorized source may be void.
1.4. Currency: All Gift Card balances and transactions are in British Pounds sterling.
2. Risk of Loss
2.1. The risk of loss and title for Gift Cards pass to the purchaser or recipient upon our electronic transmission of the Gift Card to the purchaser or designated recipient.
2.2. The Company is not responsible for any Gift Card that is lost, stolen, destroyed, or used without your permission. Treat the Gift Card like cash.
3. Expiration and Fees
3.1. Expiration: Gift Cards should be used within the calendar year with which they are purchased.
3.2. Fees: The Company does not charge any administrative or dormancy fees on Gift Cards.
4. Limitation of Liability
5.1. THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
6. General Provisions
6.1. Changes: The Company reserves the right to change these Terms from time to time in its discretion.
6.3. Severability: If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
